Terms of Service
Last updated: [to complete]
These terms of service ("Terms") govern access to and use of the Joobist service ("the Service"), operated by [Loom Digital LLC / legal name to confirm], hereinafter "Joobist", "we". Any registration for the Service implies full and unreserved acceptance of these Terms.
1. Purpose of the Service
Joobist is a job-search support service. In exchange for the payment set out in section 4, Joobist undertakes to provide the client ("you", "the Client") with:
- the creation and adaptation of their resume (CV) for each targeted job posting, including optimization for compatibility with applicant tracking systems (ATS);
- the writing of personalized cover letters for each application;
- the selection of job postings matching the criteria provided by the Client (target role, city, desired salary, hours, etc.);
- the submission of applications on the Client's behalf on the main job and recruitment platforms;
- follow-ups and reminders with the recruiters and employers contacted;
- optimization of the Client's LinkedIn profile;
- activation of Joobist's network of contacts in the human-resources field;
- the provision of documents in English and French according to the language of each posting.
2. Formation of the contract
The contract is formed at the moment the Client completes the registration form, checks the box accepting these Terms, and makes the payment set out in section 4. The payment confirmation issued by the payment provider (PayPal or other) serves as proof that the contract has been formed between the parties. The Client acknowledges having read these Terms before any payment and accepting them without reservation.
3. Accuracy of information and the Client's role
The Client undertakes to provide accurate, complete and up-to-date information regarding their background, qualifications, professional experience and contact details. The resume and documents produced by Joobist are based solely on the information provided by the Client and faithfully reflect their real background — Joobist does not invent, exaggerate or falsify any information, regardless of any request from the Client to that effect.
The Client remains solely responsible for:
- approving each document before it is sent (resume, cover letter);
- the accuracy of the information provided to Joobist and the consequences of any inaccuracy;
- their attendance, preparation and conduct during interviews, in which Joobist does not take part;
- accepting or declining any job offer obtained;
- complying with their own legal obligations (immigration status, work authorization, study permit) allowing them to hold a job in Canada.
Joobist reserves the right to suspend or terminate the Service, without refund, in the event of manifestly false, misleading or fraudulent information provided by the Client, or in the event of abusive, insulting or malicious conduct toward the Joobist team.
4. Price and payment terms
The Service is offered at the price displayed on the site at the time of registration. It is a one-time payment, made by credit card or PayPal account, giving rise to no subscription or recurring charge. No additional fees will be charged to the Client beyond the amount displayed at the time of registration, for all the services described in section 1.
Any promotional prices displayed are valid for a limited time, specified on the sales page, and may be changed at any time for new registrations. The price paid by a Client at the time of registration remains the one that applies to their file, regardless of any later change to the price displayed on the site, whether upward or downward.
Payment is processed by a third-party provider (PayPal). Joobist has no access to any of the Client's banking or card data and cannot be held liable for a technical incident attributable to the payment provider.
5. How the Service is delivered
Following payment, the Client provides Joobist with the information needed to open their file (professional background, education, existing resume where applicable, search criteria). A Joobist agent contacts the Client by phone or email within a maximum of 24 business hours after payment, except in exceptional circumstances communicated to the Client.
The resume and a template cover letter are then produced and submitted for the Client's approval before any application is sent. No application is sent to an employer without the Client having had the opportunity to review the related documents.
6. Duration of support — "until you land a job"
Joobist undertakes to continue supporting the Client until the Client obtains a job offer matching the criteria agreed at the start of the engagement (role, sector, city or region, salary range, contract type), subject to the Client meeting the following conditions:
- Minimum level of collaboration. The Client undertakes to remain reachable by phone or email, to respond to Joobist's communications within a reasonable period of five (5) business days, and to provide the additional information requested.
- Realistic and stable criteria. The search criteria are defined by mutual agreement at the start. A substantial change of criteria during the engagement may be subject to a new scoping.
- Volume and pace of applications. Joobist undertakes to submit targeted applications on a regular basis, at a pace that depends on the volume of available postings genuinely matching the Client's profile and criteria. Quality takes precedence over quantity.
- Repeated refusal of relevant offers. If the Client refuses, without a reason related to a genuine gap with the agreed criteria, three (3) offers matching the criteria initially defined, Joobist may consider its undertaking fulfilled.
- Client inactivity. If there is no response for thirty (30) consecutive days despite reminders, the engagement may be suspended and then closed, with no right to a refund.
- The job market. Joobist cannot be held liable for a lengthening of the search duration due to factors beyond its control (economic conditions, scarcity of postings, requirements that are hard to reconcile with the market).
The undertaking concerns obtaining a job offer matching the agreed criteria, and not obtaining a specific role with a specific employer, nor the Client's satisfaction with the terms of the offer obtained, provided that it meets the agreed criteria.
7. Refund policy
The Service involves immediate, personalized work as soon as the file is opened. Accordingly:
- Before any contact by a Joobist agent, within 24 hours of payment: full refund, on simple request.
- After contact but before delivery of the first finalized resume: a refund is possible, less a flat amount corresponding to the work already carried out.
- From the delivery of the first finalized resume to the Client, the Service is considered partially performed. The amount corresponding to the creation and delivery of the resume is no longer refundable, regardless of what happens next in the engagement. Only the excess portion of the payment may be discussed on a case-by-case basis.
- No refund is possible once applications have been submitted on the Client's behalf.
- A proven failure by Joobist to meet its essential obligations, after a written formal notice left unanswered for 15 days, may give rise to a partial or full refund, assessed on a case-by-case basis.
Any refund request must be sent by email to the address given in section 11.
8. Means of communication
Exchanges between Joobist and the Client take place exclusively by phone and email. Joobist does not use WhatsApp or any other instant-messaging service as part of the Service. The Client undertakes to provide a valid phone number and email address and to inform Joobist of any change of contact details, failing which the engagement may be suspended for being unreachable.
9. Confidentiality and data protection
The personal information provided by the Client is used exclusively for their job search and is shared only with recruiters and employers as part of the applications submitted on their behalf. It is neither sold, transferred to third parties for commercial purposes, nor used for solicitation without explicit consent.
The Client may request access to, correction of, or deletion of their data via the address given in section 11.
10. Intellectual property and use of documents
The documents produced by Joobist (resume, cover letters) are the Client's property upon delivery and may be freely reused by them, including after the end of the engagement. The content of the Joobist website remains the property of Joobist and may not be reproduced without authorization.
11. Contact
12. Changes to the Terms
Joobist reserves the right to change these Terms at any time. Changes apply to new registrations from the moment they are published. For a Client already registered, the Terms in force at the time of their payment apply to their engagement.
13. Governing law and dispute resolution
These Terms are governed by the law applicable at Joobist's place of establishment. The parties undertake to seek an amicable resolution of any dispute before any legal action.
14. Nature of the Service — final clarification clause
The Service is an assistance and support service. Joobist is neither an employer, nor a placement agency, nor a recruitment firm, and does not guarantee obtaining any specific role, with any specific employer, within any specific timeframe. This clarification prevails over any commercial, advertising or promotional wording that might, through simplification, suggest otherwise.
